Harley case, penultimate stop
Precautionary dismissal for the owners of imported Harley-Davidsons. These motorcycles were not approved for road use in our country.
For all motorcycle enthusiasts, the issue of “illegal” Harley Davidsons is no longer news. But let’s refresh the memory a little.
This year a series of motorcycles of the brand that had been imported from the country of origin, the United States have appeared. The problem is that these motorcycles, brought directly from the American continent, are not directly approved in our country, that is, they do not have the European approval code.
Many of these motorcycles pass the ITV (roadworthiness test) without any trouble and receive their registration document, but it is in some of the models where certain modifications to the American vehicles, compared with those delivered at dealerships here, do not match the terms of our approval. Because of this, some engineers and ITV employees have been arrested and questioned.
Finally, one of the courts we know is handling the case, the one in San Clemente (Cuenca), has issued a ruling dated October 17, declaring a “provisional dismissal” and lifting the precautionary measures imposed by the State Security Forces and Corps.
This decision was reached after clearing the individuals of “ideological falsehood” regarding the documentation of their motorcycles, and the investigation was therefore dropped due to the inconsistency of the arguments, paving the way for the Guardia Civil to return the documentation to those users whose documents had been temporarily withdrawn. The other court handling the facts, the one in Murcia, will surely follow the same ruling.
As for the new approval or their permits to be able to ride, that is a separate issue which still has no solution. At the very least, the situation seems to be gradually clearing up and without many consequences for fans of the Harley-Davidson brand.

La pista está en definir quien ha cometido el “error” o la presunta “estafa” si es que esta existe.
En cualquier caso, excepto que el documento sea falsificado, esto es en concreto, un documento confeccionado por alguien ajeno al Ministerio de Industria, lo que haria de la tarjeta Tecnica de “FALSIFICADA” y pondré un ejemplo muy grafico que todos vais a entender…..
“Un billete falsificado, el banco de España no tiene responsabilidad sobre el, pero si el Banco de españa o la Fabrica Nacional de MOneda y Timbre, emite unos billetes “erroneos” (por ejemplo con la tinta mal, sin la firma del tesorero, etc..) el valor faccial y la legalidad del mismo no admite discusión y lo unico que procedería sería el cambio por uno nuevo. Luego internamente imagino, se procedería a dirimir responsabilidades”
Aqui ha pasado lo mismo, las fichas tecnicas, están redactadas con error, s/se comenta, hasta si se me apura, supuestamente, se han puesto de acuerdo todos los importadores de España, que un grupo homogeneo, bien compactado, unido, capaz de negociar unitariamente en todo el territorio nacional (vamos la leche) poniendo de acuerdo a todos los tecnicos para que se “equivoquen”, pues aún así, si quien ha emitido la Ficha tecnica del Vehiculo, tenia capacidad de hacerlo en ese momento, a quien “equivoca” en uso de sus facultades, es al Ministerio de Industria, nunca al importador y por ende, al consumidor final.
Otro ejemplo gráfico….
Voy un dia al banco, hago un ingreso de 100.000 euros, me sellan el documento, entrego el dinero y el apoderado coge los 100.000 euros (el mismos que me ha firmado la entrega) y se dá a la fuga…….¿A quien ha robado?… AL BANCO, no al cliente….entendido…????
Por cierto, que se sepa, nadie ha comentado de la responsabilidad penal o civil, si existe, del tecnico del Ministerio, de los importadores o de quien sea….
Otra, y porque no se ha tomado la medida de una nueva ITV que obligue, a quien porceda, a cambiar los elementos que no se ajusten…sean estos los que sean…???
Otra más, porque el juzgado no ha solicitado las documentaciones a Tráfico, existen expedientes completos “ORIGINALES” de cada una de nuestros motos……
Yo a esto lo llamo SUPUESTO “SECUESTRO”, asi os tengo por los cojones y haceis lo que a mi me de la gana…
En cualquier caso nosotros, los compradores somos TERCEROS DE BUENA FE y la justicia nos debe de asistir en garantizar nuestros derechos…….(permitirme que me ria, con la pandereta en la mano y cantando …CLAVELITO….CLAVELITO….)
Haran con nosotros lo que quieran, porque ellos tienen la fuerza ( como en Star War), pero no somos gilipollas ..
Esta claro…????
